Aaron Persky

Aaron Persky is the California judge and subject of a recall petition from his run for Seat 18; Persky sparked major outrage after he sentenced a former Stanford University swimmer to just six months in jail for raping an unconscious woman.

The victim labeled the sentence imposed by Aaron Persky as a “mockery of the seriousness of his assault” and called a “ slap on the wrist ” by the San Jose Mercury News.

Brock Allen Turner is the Stanford swimmer who was convicted of 3 counts of sexual assault. Tuner –who was caught in the act by witnesses –was only given 6 months in jail, allegedly because Judge Aaron Persky was concerned about the “impact” jail time would have on his future.

The recall petition states that the ‘judge is dangerous and those who abet rapists should not have a place in our judicial system.’ It also notes, Aaron Persky ability to be impartial is clouded in part because he was part of the athletics program at Stanford as a lacrosse coach and is also a former Stanford student himself. Furthermore, it is not the first time he has shown bias in favor of athlete students.

Aaron Persky a Berkeley native, was appointed to Santa Clara County Superior Court in 2003 by Gov. Gray Davis. He attended UC-Berkeley School of Law and previously worked at the San Francisco Superior Court (1990 to 1991); Morrison & Foerster.

According to The Recorder, Persky revealed what he liked most about being a judge, saying:

I like the fact that you can have a series of careers within one larger career. When I was first appointed, I went into criminal preliminary examinations, which is not a huge stretch because I had been a prosecutor for the previous six years. Then I went to general misdemeanors, then to drug court, which is a problem-solving court. I did a vertical criminal calendar in Sunnyvale, and then I did three years in family court, and now I’m doing civil trials. Those three assignments are so different, and I just like the fact that you have the opportunity to switch gears every few years, do something completely different. We’re the ultimate generalists. But, when you do switch assignments, you have to get up to speed, so there’s a learning curve. It keeps you on your toes. It’s challenging, and it’s also a nice change of pace.

You can read the full interview here . Aaron Persky also served as the chair of the community outreach committee for the court. He has attended various groups and schools and given talks about the court. He has also presided over the mock trial program at Santa Clara County for high school students. He was the 2011 the presiding judge for that year’s  final round.

Brock Turner –who was caught behind a dumpster outside a campus frat party back in 2015 by two students who held him until police arrives –was also sentenced to three years’ probation and has to register as a sex offender for the rest of his life.
